Effective Date: August 11, 2026
These Terms of Service (“Terms”) govern your access to and use of https://comfortcare.scriptsusa.com (the “Website”) and your purchase of products from Friendly Essentials, doing business as ComfortCare by ScriptsUSA (“Company,” “we,” “our,” or “us”).
Please read these Terms carefully.
By accessing the Website, creating an account, or placing an order through the Website, you agree to these Terms and to our other policies incorporated into these Terms, including our Returns, Refunds & Cancellation Policy and Privacy Policy.
If you do not agree to these Terms, do not use the Website or place an order.
1. Eligibility
By using the Website or placing an order, you represent that you are legally capable of entering into a binding agreement.
If you make a purchase on behalf of another individual, business, facility, organization, or other entity, you represent that you have authority to make that purchase.
2. Products
We sell incontinence, healthcare, hygiene, personal-care, and related products.
Products may include:
- Adult diapers and briefs;
- Protective underwear and pull-ups;
- Disposable underpads;
- Incontinence pads;
- Wipes;
- Gloves;
- Personal-care products;
- Healthcare supplies; and
- Related products and accessories.
We make reasonable efforts to accurately describe and display our merchandise.
However, manufacturers may change packaging, labeling, materials, designs, dimensions, colors, product counts, features, or other specifications.
Product photographs are provided for reference and may not always exactly represent the packaging or appearance of the merchandise received.
3. Product Availability
All products are subject to availability.
The inclusion of a product on our Website does not guarantee that the product is currently in stock or available for immediate shipment.
We reserve the right to discontinue merchandise or limit quantities at any time.
4. Product Information
We make reasonable efforts to provide accurate product descriptions, sizing information, quantities, absorbency information, specifications, and other product information.
However, errors may occasionally occur.
Customers should review manufacturer packaging, labels, instructions, warnings, and other product information before using merchandise.
If information on the manufacturer's packaging differs from information displayed on our Website, customers should contact us if clarification is needed before using the product.
5. Not Medical Advice
The Website and information provided by our employees, representatives, or customer-service personnel are provided for general informational purposes.
Nothing on the Website is intended to constitute medical advice, medical diagnosis, treatment advice, nursing advice, or other professional healthcare advice.
Information concerning sizing, absorbency, product types, incontinence levels, or product selection is general information only.
Customers should consult an appropriate physician, nurse, healthcare professional, or caregiver when professional medical advice is required.
6. Customer Responsibility for Product Selection
Customers are responsible for selecting the product appropriate for their needs.
Before ordering, you are responsible for reviewing:
- Product type;
- Size;
- Absorbency;
- Quantity;
- Package count;
- Case count;
- Product specifications; and
- Other relevant product information.
Recommendations or assistance provided by us do not constitute a guarantee that a particular product will fit or satisfy a customer's individual needs.
7. Orders
Placing an order constitutes an offer to purchase merchandise.
Receipt of an automated order confirmation does not necessarily mean that we have finally accepted the order.
We reserve the right, to the extent permitted by applicable law, to reject, limit, or cancel an order for legitimate reasons, including:
- Product unavailability;
- Incorrect pricing;
- Incorrect product information;
- Suspected fraud;
- Unauthorized payment activity;
- Shipping restrictions;
- Quantity limitations;
- Technical errors; or
- Other circumstances that reasonably prevent fulfillment.
If we cancel paid merchandise that has not been shipped, we will refund amounts collected for that canceled merchandise as required by applicable law.
8. Prices
All prices are stated in U.S. dollars unless otherwise indicated.
Prices may change without notice.
A price change will not ordinarily affect a previously accepted order.
Despite reasonable efforts to maintain accurate pricing, typographical, technical, or other pricing errors may occur.
If a material pricing error occurs, we may cancel the affected order to the extent permitted by applicable law and refund amounts collected for merchandise that will not be fulfilled.
9. Taxes
Applicable sales, use, and other transaction taxes may be charged based on the order and applicable law.
Customers are responsible for taxes applicable to their purchases except taxes imposed directly on our income.
11. Fraud Prevention
We may take reasonable measures to prevent fraud and unauthorized transactions.
We may request additional verification before fulfilling an order.
We may refuse or cancel transactions that we reasonably believe involve fraud, unauthorized payment activity, abuse, or other unlawful conduct, subject to applicable law.
12. Returns, Refunds and Exchanges
ALL SALES ARE FINAL.
Due to the personal, hygienic, and sanitary nature of the products we sell, we do not accept returns or exchanges, including unopened and unused merchandise.
Customers are responsible for confirming the correct product, size, absorbency, quantity, and specifications before placing an order.
Ordering an incorrect size or product, changing your mind, ordering more merchandise than needed, or no longer needing the product does not make merchandise returnable.
This provision is subject to our complete Returns, Refunds & Cancellation Policy, which is incorporated into these Terms.
Nothing in these Terms eliminates any right or remedy that cannot lawfully be waived.
13. Damaged, Defective, Incorrect or Missing Merchandise
Customers should contact us promptly if merchandise:
- Arrives damaged;
- Is defective;
- Is different from the merchandise ordered; or
- Is missing from the shipment.
We may require reasonable documentation, including photographs, order information, shipping labels, product information, and a description of the issue.
If we confirm an eligible claim, we may provide a replacement, refund, partial refund, or other appropriate resolution depending upon the circumstances and applicable law.
Customers must not return merchandise without our authorization.
14. Order Cancellation
Customers may contact us to request cancellation before an order is processed or shipped.
Cancellation requests are not guaranteed.
Once an order has been processed, packed, submitted for fulfillment, or shipped, it generally cannot be canceled.
15. Shipping
Shipping and delivery estimates are estimates unless expressly stated otherwise.
We make reasonable efforts to fulfill orders within the shipping time represented at the time of purchase.
Shipping or delivery may be affected by circumstances including:
- Carrier delays;
- Weather;
- Natural disasters;
- Holidays;
- Transportation interruptions;
- Incorrect addresses;
- Product availability;
- Security issues; and
- Circumstances outside our reasonable control.
When shipment cannot occur within the applicable required timeframe, the order will be handled in accordance with applicable law.
16. Delivery
Customers are responsible for providing a complete and accurate delivery address.
Customers should use an address where packages can safely be received.
Tracking information may be provided when available.
If you believe an order was lost, incorrectly delivered, or not delivered, contact us promptly so that we can review available tracking and carrier information.
17. Refused and Undeliverable Shipments
Refusal of a shipment does not automatically cancel the order or entitle the customer to a refund.
If merchandise is returned because the customer supplied an incorrect or incomplete address, we may charge reasonable additional shipping or reshipping costs to the extent permitted by applicable law.
18. Accounts
If our Website permits customer accounts, you are responsible for maintaining the confidentiality of your username, password, and account credentials.
You are responsible for activity occurring through your account except to the extent prohibited by applicable law.

We may modify, suspend, maintain, or discontinue portions of the Website when reasonably necessary.
23. Warranties and Disclaimers
To the fullest extent permitted by applicable law, the Website and its content are provided on an “as available” basis.
We make no guarantee that information on the Website will always be error-free or that the Website will operate without interruption.
Products may be subject to warranties, instructions, or representations provided by their manufacturers.
Nothing in these Terms disclaims or limits any warranty or consumer protection that cannot legally be disclaimed or limited.
24. Product Use
Customers are responsible for following product instructions, warnings, storage requirements, sizing information, and manufacturer recommendations.
Products should be used only for their intended purposes.
To the fullest extent permitted by applicable law, we are not responsible for injury, loss, damage, or other consequences resulting from misuse, improper storage, unauthorized modification, or use contrary to product instructions.
25. Limitation of Liability
To the fullest extent permitted by applicable law, Friendly Essentials, ComfortCare by ScriptsUSA, and their respective owners, officers, employees, affiliates, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to use of the Website or purchase or use of merchandise.
To the fullest extent permitted by applicable law, our aggregate liability arising from a particular purchase will not exceed the amount paid to us for the merchandise giving rise to the claim.
This limitation does not apply where liability cannot lawfully be excluded or limited.
26. Chargebacks and Payment Disputes
If there is a problem with your order, we encourage you to contact us before initiating a payment dispute.
When a chargeback or payment dispute occurs, we may provide relevant transaction information to the payment processor, issuing bank, card network, financial institution, or other party reviewing the dispute.
Such information may include:
- Order records;
- Checkout records;
- Acceptance of applicable policies;
- Payment information;
- Tracking information;
- Proof of delivery;
- Communications;
- Product information; and
- Our Returns, Refunds & Cancellation Policy.
Nothing in this section restricts any lawful right to dispute an unauthorized or otherwise legally disputable charge.
27. Privacy
Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.
Please review our Privacy Policy before using the Website or placing an order.
28. Electronic Communications

We may revise these Terms from time to time.
When we revise them, we will post the updated version on the Website and update the Effective Date.
Changes apply prospectively except where applicable law provides otherwise.
The Terms applicable to a transaction will generally be the Terms in effect when that transaction is made.
30. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed if necessary.
The remaining provisions will remain in effect.
31. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
32. Governing Law
These Terms and transactions with us will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent another applicable law cannot legally be waived or requires otherwise.
Nothing in these Terms is intended to deprive a consumer of a right or protection available under applicable federal, state, or local law that cannot legally be waived by agreement.
33. Jurisdiction
Subject to any rights or requirements that cannot legally be waived, disputes arising from these Terms, the Website, or purchases from us will be subject to the jurisdiction of courts having lawful jurisdiction over the matter.
Nothing in this provision requires a consumer to waive a venue or jurisdiction right that applicable law makes non-waivable.
